Terms of purchase
1. General & Bidding
1.1 Bidding requires an active, verified account with Enigma Auktion. All bids placed are legally binding.
1.2 The winning buyer is the highest accepted bid at the close of the auction. In the event of identical bids, the bid registered earliest takes precedence.
1.3 Enigma Auktion reserves the right to reject bids, terminate accounts, or cancel bids at its sole discretion in cases of suspected fraudulent activity, shill bidding, or failure to meet credit requirements.
2. Absentee & Automated Bids
2.1 Bidders may submit maximum absentee bids online prior to the auction.
2.2 Enigma Auktion handles absentee bids confidentially and executes them automatically on the buyer’s behalf as favorably as competing bids allow, up to the maximum specified limit.
3. Estimated Prices
3.1 Asking prices (utropspris) represent a market-based valuation conducted by Enigma Auktion’s specialists. Estimates serve strictly as a guide; final hammer prices may vary significantly.
4. Buyer’s Premium & Fees
4.1 On all winning hammer prices, the buyer agrees to pay:
- A Buyer’s Premium of 25% (inclusive of VAT).
- A Hammer Fee of SEK 80 (inclusive of VAT) per lot. 4.2 Resale Right (Droit de suite): Pursuant to the Swedish Copyright Act (Lag 1960:729 om upphovsrätt), a resale levy of up to 5% applies to qualifying original works of art, glass, ceramics, textiles, and furniture by protected artists (up to 70 years posthumously). Applicable lots are clearly marked with a D in the catalog.
5. Payment Terms
5.1 Full payment must be settled within seven (7) calendar days following the auction end date.
5.2 Payment can be made via card payment on our website, bank transfer, or approved digital checkout methods. We do not accept cash or American Express.
5.3 Overdue Payments: If payment is not received within 7 days, Enigma Auktion reserves the right to:
- Charge a late payment penalty fee of SEK 50 plus a default interest rate of 2% per month.
- Cancel the sale and/or re-consign the lot for sale on the buyer’s account, applying any proceeds toward outstanding debts and costs incurred.
6. Collection & Storage
6.1 Purchased lots may be collected from our premises in Tierp once full payment has cleared. All items must be collected within seven (7) calendar days after the auction.
6.2 Late Pickups: Uncollected items after 7 calendar days incur a storage fee of SEK 50 (incl. VAT) per lot, per calendar day.
6.3 Risk for the item passes to the buyer upon payment or at the expiration of the 7-day pickup period. Enigma Auktion is not responsible for damage or loss to uncollected goods past this period.
6.4 All shipping and transport are arranged at the buyer’s risk and expense.
7. Condition, Liability & Examination
7.1 All lots are sold "as is" (i befintligt skick). Buyers are encouraged to inspect items in person during public preview days or request a detailed written condition report prior to bidding.
7.2 Natural wear and tear, age-related fading, minor frame damage, wood movement, or small imperfections do not constitute grounds for return or compensation.
7.3 Clocks, Mechanical & Electrical Items: Clocks, watches, light fixtures, and mechanical or motorized objects are sold as decorative objects/works of art. Enigma Auktion does not guarantee their technical functionality or electrical safety.
7.4 Catalog Information: Descriptions regarding age, attribution, material, or provenance serve as expert guidance. Enigma Auktion is liable for errors in key attribution only in cases of gross negligence.
8. Right of Withdrawal (Ångerrätt)
8.1 Consumer buyers purchasing via distance auctions have a statutory 14-day right of withdrawal in accordance with the Swedish Distance Contracts Act (Lag 2005:59 om distansavtal).
8.2 The withdrawal period expires 14 days from the date the buyer takes physical possession of the lot.
8.3 To exercise the right, the buyer must notify Enigma Auktion in writing (e.g., via email to info@enigma-auktion.se) within the 14-day window. The buyer is responsible for return transport costs and ensuring the lot arrives back in its original condition.
9. Disputes & Applicable Law
9.1 These terms are governed exclusively by Swedish law. Any dispute arising under or in connection with these terms shall be settled in a competent court of Sweden.
