Terms of sale

1. Scope & Consignment

1.1 Enigma Auktion undertakes to act as an agent on behalf of the seller (consignor) to market and sell consigned items at auction under the following terms.

1.2 Enigma Auktion reserves full discretion to determine auction timing, lot groupings, cataloging descriptions, and marketing channels to achieve optimal results.

2. Seller Warranties & Title

2.1 The seller warrants that they possess full, unrestricted ownership and legal title to all consigned items, or hold unconditional written authority from the owner to sell and receive funds.

2.2 The seller is obligated to inform Enigma Auktion in writing of any known defects, restorations, repairs, or doubts regarding authenticity.

2.3 Enigma Auktion reserves the right to withdraw any item from auction at any time, without liability to the seller, if doubts arise regarding authenticity, legal ownership, provenance, or description accuracy.

2.4 Withdrawal by Seller: Consignments may not be withdrawn by the seller within 3 days prior to public preview or live auction. In the event of an approved earlier withdrawal, the seller shall reimburse Enigma Auktion for handling, valuation, and cataloging fees equivalent to the seller’s commission based on the estimated reserve price.

3. Valuation & Cataloging

3.1 Asking prices (utropspris) are non-binding estimates based on market valuations conducted by Enigma Auktion’s specialists.

3.2 All photographs, text descriptions, and promotional materials created by Enigma Auktion remain the exclusive intellectual property of Enigma Auktion and may be used for marketing and archival purposes indefinitely.

4. Seller Fees & Commission

4.1 For each cataloged lot sold, the seller agrees to the following deductions from the final hammer price:

• A Seller Commission of 18.75% (inclusive of VAT).
• A Lot Administration Fee of SEK 80 (inclusive of VAT) per lot, covering professional photography, cataloging, and insurance during storage.

5. Reserve Prices (Bevakningspris)

5.1 A reserve price is an agreed-upon minimum hammer price below which the lot will not be sold. Reserve prices may not exceed the lower estimate.

5.2 Reserve prices are generally applied only to items with an estimated value of SEK 1,000 or higher (typically set at a maximum of 80% of the estimate), unless otherwise agreed in writing.

5.3 Enigma Auktion reserves the right to sell an item below the agreed reserve price, provided the seller receives a payout calculated as if the item had reached the agreed reserve price.

6. Payouts & Settlement

6.1 Payouts to the seller are processed thirty (30) days after the auction date, provided the buyer has settled payment in full and no statutory right of withdrawal (ångerrätt) or valid defect claim has been exercised.

6.2 If a buyer exercises their statutory 14-day right of withdrawal under distance contract laws, the sale is canceled, and the lot will be re-listed in an upcoming auction under unchanged seller terms.

6.3 Payouts are made directly to the seller’s verified Swedish bank account. Enigma Auktion maintains client funds in dedicated separate accounts in accordance with Swedish accounting laws.

6.4 Enigma Auktion reserves the right to set off any outstanding debts owed by the seller against auction proceeds.

7. Unsold Items

7.1 Unless otherwise agreed, Enigma Auktion reserves the right to re-offer unsold items in up to three (3) subsequent auctions, with adjusted estimates/reserves.

7.2 If an item remains unsold and is not to be re-listed, the seller must collect the item within seven (7) calendar days of notification.

7.3 Unclaimed Items: Items uncollected after 7 calendar days incur a storage fee of SEK 50 (incl. VAT) per lot, per day. Items uncollected after 30 days may be re-sold without reserve or donated to charity to cover accrued storage costs.

8. Anti-Money Laundering (AML) & Data Privacy

8.1 In compliance with the Swedish Anti-Money Laundering Act (Lag 2017:630), Enigma Auktion is legally required to verify the identity of sellers and beneficial owners.

8.2 Personal data provided by the seller is processed in accordance with EU GDPR regulations and Enigma Auktion’s Privacy Policy.

9. Disputes & Applicable Law

9.1 These terms shall be governed by and construed in accordance with Swedish law. Any dispute shall be settled by a competent court in Sweden.
